Terms of Service

1. Acceptance of terms

By creating an account or using Quailgent, you agree to these Terms of Service and our Privacy Policy. If you use Quailgent on behalf of a company, you confirm you have the authority to bind that company to these terms.

2. The service

Quailgent provides an AI calling agent for outbound campaigns, a campaign dialer that places calls through Twilio, a lead pipeline with call transcripts and recordings, and call quality scoring. It does not answer inbound calls on behalf of customers. Features, limits and AI minute allowances vary by plan and are described on our Pricing page.

3. Accounts

You must give accurate information when you register and keep your login credentials secure. You are responsible for all activity under your account, including activity by team members you add.

4. Your responsibilities when you call

You decide who is called and what the agent says, so you are responsible for having a lawful basis to call every lead you upload. That includes obtaining any consent that applies, respecting do-not-call and preference registers, calling only at permitted hours, and following the telemarketing, privacy and data protection laws of the countries you call, for example the TCPA in the United States, PECR and UK GDPR in the United Kingdom, and the GDPR in the European Union. You must also comply with the laws on recording calls and on disclosing that a caller is an automated system.

5. AI disclosure and recording

Quailgent's agent opens each call by saying it is an AI assistant calling on a recorded line, and ends the call and marks the lead do-not-call if someone asks not to be called. You must not change a script to hide that the caller is an AI or that the call is recorded, and you must not use Quailgent to deceive people about who is calling.

6. Acceptable use

You must not use Quailgent to place unlawful, harassing, fraudulent or deceptive calls, or to call numbers you have no right to call. We may suspend an account that does.

7. Payment and billing

Plans are billed in US dollars, paid by bank transfer, and activated once we confirm your payment. The free trial is available once per account. A paid pilot, where offered, is credited against the first month of a Growth plan if you continue. Fees are non-refundable except where the law requires otherwise. AI minutes beyond a plan's allowance are charged at the overage rate shown on the Pricing page.

8. Limitation of liability

Quailgent is provided "as is". To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from your use of the service, including missed calls, lost leads or regulatory penalties that result from how you use it.

9. Changes to these terms

We may update these terms from time to time. We will email account owners before material changes take effect. Continuing to use Quailgent after that date means you accept the updated terms.
